According to Article 3(e) of the EU ETS Directive, an installation is a stationary technical unit where one or more activities under the scope of the European Union Emissions Trading Scheme (EU ETS) and any other directly associated activities which have a technical connection with the activities carried out on that site and which could have an effect on emissions and pollution.

 
Note also the interpretation of the European Court of Justice in the judgment of 9 June 2016 (Case C‑158/15, Elektriciteits Produktiemaatschappij Zuid-Nederland EPZ NV v Bestuur van de Nederlandse Emissieautoriteit) regarding a fuel storage site of a coal-fired power plant as part of an ‘installation’ within the above meaning (in the context of self-heating).

 

According to Article 3(3) of the Directive 2010/75/EU of the European Parliament and of the Council on industrial emissions of 24 November 2010 (integrated pollution prevention and control - IED) ‘installation’ means a stationary technical unit within which one or more activities listed in Annex I of the IED or in Part 1 of Annex VII IED are carried out, and any other directly associated activities on the same site which have a technical connection with the activities listed in those Annexes and which could have an effect on emissions and pollution.
